Terms of Service

By accessing, browsing, or using the RoomFinderAI platform (the "Platform"), mobile applications, or any services provided by RoomFinderAI ("we," "us," or "our"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), along with our Privacy Policy and Acceptable Use Policy.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE PLATFORM.

• "Platform" refers to the RoomFinderAI website, mobile applications, and all related services.
• "User" refers to any person or entity using the Platform, including tenants, landlords, roommates, and property seekers.
• "Listing" refers to any property, room, or housing opportunity posted on the Platform.
• "Landlord" refers to property owners, managers, or authorized representatives listing properties.
• "Tenant" refers to individuals seeking housing or roommates through the Platform.
• "AI Tools" refers to artificial intelligence-powered features including the Personal Rental Agent, rent negotiation assistant, and recommendation systems.
• "Content" refers to all text, images, videos, data, and materials posted by Users on the Platform.

3.1 Account Creation

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Immediately notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

3.2 Account Verification

We may require identity verification, including:

• Government-issued ID verification
• Facial recognition verification
• Phone number verification
• Email confirmation

Verified accounts receive a "Verified" badge. Verification does not constitute an endorsement or guarantee by RoomFinderAI.

3.3 Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms, our Acceptable Use Policy, or engage in fraudulent, illegal, or harmful activities.

4.1 Permitted Uses

You may use the Platform to:

• Search for and view housing listings
• Post legitimate property listings (if you are a landlord or authorized representative)
• Communicate with other Users through our messaging system
• Use AI tools for negotiation guidance and market analysis
• Match with compatible roommates
• Facilitate sublease transfers
• Access legal resources and calculators

4.2 Prohibited Uses

See our Acceptable Use Policy for detailed prohibited conduct. You agree NOT to:

• Post false, misleading, or fraudulent listings
• Discriminate based on race, color, religion, sex, national origin, familial status, or disability
• Harass, threaten, or abuse other Users
• Scrape, crawl, or use automated tools to access the Platform
• Impersonate others or create fake profiles
• Violate any local, state, national, or international law
• Upload malicious code, viruses, or harmful content

4.3 Marketplace Intermediary

5.1 Listing Accuracy

Landlords and property posters represent and warrant that all listing information is:

• Accurate and truthful
• Not misleading or deceptive
• Compliant with fair housing laws
• Represents a property you are authorized to list
• Includes authentic photos of the actual property

5.2 Content Ownership & License

You retain ownership of all Content you post on the Platform. By posting Content, you grant RoomFinderAI a worldwide, non-exclusive, royalty-free, transferable license to:

• Display, reproduce, and distribute your Content on the Platform
• Use your Content for marketing and promotional purposes
• Create derivative works (e.g., thumbnails, compressed images)
• Sublicense to third-party service providers necessary for Platform operation

5.3 Content Moderation

We reserve the right, but are not obligated, to:

• Remove or modify Content that violates these Terms
• Remove listings for fraudulent or inappropriate properties
• Monitor communications for safety and compliance
• Report illegal activity to law enforcement

5.4 File Upload Limits

The Platform allows file uploads (photos, documents, lease agreements) with the following limits:

• Maximum file size: 5MB per file
• Accepted formats: JPG, PNG, PDF, DOCX, TXT
• Responsibility: You are solely responsible for the content of uploaded files

6.1 Personal Rental Agent (AI Negotiation Tool)

You understand and agree that:

• AI recommendations are based on market data and negotiation principles, but actual outcomes vary
• You are responsible for verifying all AI-generated information
• Negotiation success depends on landlord willingness, market conditions, and your circumstances
• You should consult a qualified attorney for legal matters
• AI tools use data and algorithms that may contain errors or biases
• RoomFinderAI holds no liability for negotiation outcomes or disputes arising from AI tool use

6.2 AI Tool Acceptance

Before using AI negotiation tools, you will be required to accept a specific disclaimer acknowledging:

• The limitations of AI-generated guidance
• Your responsibility to verify information
• The non-legal nature of AI advice
• RoomFinderAI's limitation of liability

6.3 AI Matching & Recommendations

Our roommate matching and listing recommendation systems use AI algorithms. These are suggestions based on your preferences and may not be perfect matches. You are responsible for:

• Verifying compatibility with potential roommates
• Inspecting recommended properties in person
• Conducting your own due diligence

7.1 Subscription Plans

RoomFinderAI offers the following subscription tiers:

• Basic (Free): Limited access to core features
• Premium: Full access to AI tools, messaging, and advanced features
• Enterprise: Custom solutions for property managers and landlords

7.2 Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you represent that:

• You are authorized to use the payment method
• Payment information is accurate and current
• You will pay all charges incurred

Important: RoomFinderAI does NOT store credit card numbers. All payment data is handled by Stripe according to PCI-DSS standards.

7.3 Billing & Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless canceled. You agree that:

• Your payment method will be charged automatically at renewal
• You are responsible for updating payment information if it changes
• Failed payments may result in service interruption
• You can cancel auto-renewal anytime from your account settings

7.4 Refunds & Cancellation

• No refunds for partial billing periods
• You may cancel your subscription at any time
• Upon cancellation, you retain access until the end of the current billing period
• After cancellation, access to Premium features is terminated

7.5 Billing Disputes

Billing disputes must be filed through our Dispute Resolution Process. We will investigate all billing concerns promptly.

8.1 RoomFinderAI Property

The Platform, including all content, features, functionality, design, code, graphics, logos, and trademarks, is owned by RoomFinderAI and protected by copyright, trademark, and other intellectual property laws.

"RoomFinderAI," the RoomFinderAI logo, and related marks are trademarks of RoomFinderAI. You may not use these marks without our prior written permission.

8.2 User Content

You retain all rights to Content you post. However, you grant us the license described in Section 5.2 above.

8.3 DMCA/Copyright Policy

We respect intellectual property rights. If you believe Content on the Platform infringes your copyright, see our DMCA Policy for filing a takedown notice.

9.1 Platform "As Is"

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Accuracy, reliability, or availability of the Platform
• Quality, safety, or legality of listings or properties
• Conduct or compatibility of Users
• Accuracy of AI-generated recommendations or advice

9.2 No Liability for User Conduct

RoomFinderAI is NOT liable for:

• Fraudulent listings or scams by Users
• Disputes between landlords and tenants
• Property condition, habitability, or code violations
• Lease agreement terms or enforcement
• Security deposit disputes or non-return
• Roommate compatibility or conflicts
• Sublease transfer issues or breaches
• Discrimination, harassment, or illegal activity by Users

9.3 AI Tool Limitations

RoomFinderAI is NOT liable for:

• Negotiation outcomes or failures
• Inaccurate market data or rent analysis
• AI recommendation errors or biases
• Legal consequences of following AI advice
• Financial losses from negotiation attempts

9.4 Maximum Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROOMFINDERAI'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF:

• The amount you paid to RoomFinderAI in the 12 months before the claim, OR
• $100 (One Hundred US Dollars)

9.5 Exclusion of Damages

ROOMFINDERAI SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Lost profits, revenue, data, or business opportunities
• Emotional distress or reputational harm
• Third-party claims related to your use of the Platform

10.1 Internal Dispute Process

Disputes between Users (landlords, tenants, roommates) should be handled through our Dispute Resolution Process:

1. Informal Resolution (7 days): Attempt direct communication
2. Formal Dispute Filing: Submit evidence through our platform
3. Mediation: Platform mediator facilitates resolution

10.2 Arbitration Agreement

You and RoomFinderAI agree that:

• Disputes will be resolved through individual arbitration, NOT court
• Arbitration will be conducted by the American Arbitration Association (AAA)
• Arbitration shall be held in [Your Jurisdiction] or remotely
• The arbitrator's decision is final and binding
• You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@roomfinderai.com

10.3 Class Action Waiver

YOU AND ROOMFINDERAI AGREE TO WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE ARBITRATIONS. Disputes must be brought individually.

10.4 Exceptions

The following disputes are NOT subject to arbitration:

• Small claims court actions (below jurisdictional limit)
• Intellectual property disputes
• Injunctive relief to prevent immediate harm

11.1 Termination by You

You may terminate your account at any time by:

• Accessing account settings and selecting "Delete Account"
• Emailing support@roomfinderai.com

11.2 Termination by RoomFinderAI

We may suspend or terminate your account immediately, without notice, if you:

• Violate these Terms or our Acceptable Use Policy
• Post fraudulent or illegal listings
• Engage in harassment, discrimination, or abuse
• Create fake accounts or impersonate others
• Attempt to hack, scrape, or compromise the Platform
• Fail to pay subscription fees

11.3 Effect of Termination

Upon termination:

• Your access to the Platform is immediately revoked
• All active listings are removed
• Subscription benefits cease (no refund for partial periods)
• Data may be deleted according to our Privacy Policy
• Certain provisions of these Terms survive termination (Sections 8, 9, 10)

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform.

Material changes will be communicated via:

• Email notification to your registered address
• Prominent notice on the Platform
• In-app notification

Continued use of the Platform after changes constitutes acceptance of the modified Terms. If you do not agree to changes, you must stop using the Platform and terminate your account.
